Terms and conditions of SSSVV Programme:
All users subscribing to Sri Sathya Sai Vidya Vahini Programme (hereinafter referred to as the “SSSVV Programme”), developed, organized and managed by the Sri Sathya Sai Central Trust, a Public Charitable Trust registered under Section 12A of the Income Tax Act, 1961, having its registered office at Prasanthi Nilayam, Puttaparthi, Andhra Pradesh, India – 515 134, hereinafter referred to as the “Trust”, hereby undertakes that they are subject to these terms which may be updated from time to time (hereinafter referred to as this “Agreement”). Please read this Agreement carefully and make sure you understand it. If you do not understand the Agreement, or do not accept any part of it, then you may opt out of the SSSVV Programme. By accepting this Agreement, you affirm that you are 18 years of age or above and are fully competent to enter into this Agreement, and to abide by and comply with this Agreement.
Intellectual Property:
The users, understand and agree, that they undertake to provide voluntary services in the SSSVV Programme, characterized by the instructions, guidance and information provided by the Trust. The Trust shall vest all rights, title and interest and Intellectual Property Rights in any Intellectual Property created, conceived, developed, contributed to or improved upon by the user during his/her voluntary services in the SSSVV Programme. The user hereby irrevocably and in perpetuity assigns to the Trust all of right, title and interest (including without limitation any and all Intellectual Property Rights) in any and all Information that the user may have conceived, created, improved upon, developed or contributed, as part of his/her association with the Trust (including as part of voluntary services undertaken for the SSSVV Programme of the Trust). The user agrees and understands that any and all works that are prepared by the user, are voluntary “Pro Bono” service for the welfare and benefit of all and thus the users hereby waives all rights including his/her right as an author arising out of the same. The user hereby waives any right to and agrees that he shall not raise any objection or claims under applicable law in respect of ownership of such Trust Intellectual Property. During the Voluntary services, whatever gets created, developed, modified in any format by the user with or without the assistance or involvement of any other Person during the Term using own tools or the Trust’s or its Partners’/Affiliates’ tools and systems will always be property of the Trust. The user hereby undertakes to do all acts, deeds and things including execution of necessary documents without charge or compensation but at the cost of the Trust for fully and effectively vesting in the Trust the rights in any Intellectual Property Rights arising out of his voluntary services. The user represents and warrants that the user has not violated and agrees not to violate the Intellectual Property Rights of any third party in the course of his/her voluntary services. Notwithstanding anything to the contrary, no license with respect to Intellectual Property Rights shall be deemed or implied to be granted by the Trust to the user in respect of the Trust’s Intellectual Property.
Confidentiality & Non-disclosure:
Users shall hold and maintain all proprietary and confidential data or information of the Trust (hereinafter referred to as this “Confidential Information”) received as part of SSSVV Programme in strictest confidence for the sole and exclusive benefit of the Trust. users shall carefully restrict access to Confidential Information to third parties as is reasonably required and shall require those persons to sign non-disclosure restrictions at least as protective as those in this Agreement. Users shall not, without the prior written approval of the Trust, use for users' benefit, publish, copy, or otherwise disclose to others, or permit the use by others for their benefit or to the detriment of the Trust, any Confidential Information. users shall return to the Trust any and all records, notes, and other written, printed, or tangible materials in their possession immediately if Trust requests it in writing. The non disclosure provisions of this Agreement shall survive the termination of this Agreement and users' duty to hold Confidential Information in confidence shall remain in effect until Trust sends the users written notice releasing the users from this Agreement. Furthermore, outgoing users will immediately and voluntarily exit from all cloud platforms, where they were provided access to Trust files in platforms such as Google Drives, WhatsApp groups etc.
Legal Action & Jurisdiction:
Users failing to comply with the terms of this Agreement shall be liable for appropriate legal action. Indian law will govern all disputes arising out of or relating to this Agreement. Courts in Puttaparthi, Sri Sathya Sai District, Andhra Pradesh shall have exclusive jurisdiction for disputes, if any, arising out of this Agreement.
